Terms and Conditions


Please read these Terms of Service (‘Terms’, ‘Terms of Service’) carefully before using our service and website (the ‘Service’) operated by ZA Luxe Trading and Services (‘us’, ‘we’, or ‘our’).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

1.0 Accounts
When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security.

2.0 Termination
We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability. We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

3.0 Governing Law
These Terms shall be governed and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service Changes.

4.0

4.1 We takes all reasonable care, in so far as possible, to keep the details of your Order and payment secure, but in the absence of negligence on our part, we will not be liable for any loss you may suffer if a third party procures unauthorised access to any Personal Information you provide when accessing or placing an Order on the Platforms.

4.2 The technical steps to place your Order and create a contract of sale between you and us are, as follows:

a) You place an order on the website by pressing the ‘Add to Cart’ button at the end of the checkout process.

b) We will send you an email confirming your Order which will detail the Product(s) (including their Product Descriptions) that you have ordered. This email does not constitute an acceptance of your Order by us and a contract does not exist between us at this point.

c) If your chosen item is/are not available, we will contact you for the options available or a refund to the original payment method will be issued.

d) As your Order is shipped by us we will send you a dispatch confirmation email including the tracking number.

e) Alternatively, in relation to our ‘Click & Collect’ service, we will send you an email (as well as possibly an Whatsapp) to confirm that your Order is ready for collection. Upon sending either of email or whatsapp, your Order will be taken to have been accepted by us unless we have notified you that we do not accept your Order, or you have cancelled it.

d) Subject to us having accepted your Order, we will then arrange for delivery of it to you at your nominated address or make it available for collection through our Click & Collect service.

4.3 Non-acceptance of your Order (or parts of your Order) may be due to any one or more of the following non-exhaustive reasons:

a) A Product you ordered is out of stock;

b) We are unable to obtain authorisation for your payment;

c) We have identified an error with a Product Description, including but not limited to a pricing error;

d) You do not meet the eligibility requirements as specified in these Terms and Conditions;

e) There is a system or procurement failure;

f) You fail our customer validation checks;

g) There are restrictions (legal or otherwise) or practices in relation to a Product which prevent us from being able to sell or deliver it to you; or

h) We believe you are generating orders for commercial gain and not personal use;

4.4 We reserve the right to cancel your Order even after we have accepted it, for any of the reasons listed in Clause 4.3 of these Terms and Conditions.

5.0 Payment and payment methods on the Platforms

5.1 You can currently pay in Malaysia Ringgit and British Pounds or such other currency as we may accept from time to time.

5.2 We accept payment for Orders by MasterCard, Visa, PayPal, Bank Transfer, Grab Pay, Maybank QR code and Cash during collection.

5.3 If you choose to pay for your Order using a payment card with a currency denominated account that is different from the currency you are paying in, your payment card will be charged in the payment currency at the foreign exchange rate applied by your relevant payment card provider or bank at the time of processing your Order. Your international payment card provider or bank will determine the foreign exchange rate and may add an additional processing or administration charge which you will be liable to pay.

5.4 By placing your Order and making an offer to buy a Product, you authorise us to transmit information (including any updated information) or to obtain information about you from third parties from time to time and this may include verification checks involving your debit or credit card number or credit reports in order to authenticate your identity; to validate your credit card; to obtain an initial credit card authorisation; to protect you and us from fraud; and to enable us to arrange delivery of your Order to your nominated delivery address.

6.0 Delivery

6.1 You must provide us with complete and accurate delivery address information. For the avoidance of doubt, this includes not only the address that your Order is going to, but also the name of its recipient. We will not be liable for the delivery of your Order as a result of you supplying us with incomplete or inaccurate information. Parcels may require a signature on delivery.

6.2 We will make every effort to deliver your Order within the estimated timescales. Our normal delivery timescale up to 5 working days from the date you are receiving confirmation of your order. However delays are occasionally inevitable due to unforeseen factors or events outside our control, for example, material shortages, travel or transportation disruption, import delays or higher-than-anticipated demand. We shall not be liable for any delay or failure by us to deliver your Order within the estimated timescales as a result of such delays. Please note that delivery of your Order may take longer during sale or other busy periods.

6.3 Currently, we only deliver within Malaysia. Shall you need your order to be sent outside Malaysia, please contact us. We also offering same day delivery for Klang Valley area only.

7.0 Return

7.1 All sales are final. No refund or returns will be accepted if you change your mind after payment has been made.

 7.2 However, you have [7] calendar days to return an item from the date you received it in case if there is manufacturer defect ONLY. To be eligible for a return, your item must be unused and in the same condition that you received it. Your item must be retuned in the original packaging. Please provide receipt or proof of purchase.


8.0 Price

8.1 Price shown in the website is final price. Any negotiation would not be entertained.

8.2 Price shown in the website inclusive of base price for the item and service fee imposed by us. No additional fee required except for the local postage cost which will be determined during check out.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
